Summary of Civil and Criminal Penalties for Violation of Federal Copyright Laws Copyright infringement is the act of exercising, without permission or legal authority, one or more of the exclusive rights granted to the copyright owner under section 106 of the Copyright Act (Title 17 of the United States Code). These rights include the right to reproduce or distribute a copyrighted work. In the file-sharing context, downloading or uploading substantial parts of a copyrighted work without authority constitutes an infringement. Penalties for copyright infringement include civil and criminal penalties. In general, anyone found liable for civil copyright infringement may be ordered to pay either actual damages or “statutory” damages affixed at not less than $750 and not more than $30,000 per work infringed. For “willful” infringement, a court may award up to $150,000 per work infringed. A court can, in its discretion, also assess costs and attorneys’ fees. For details, see Title 17, United States Code, Sections 504, 505. Willful copyright infringement can also result in criminal penalties, including imprisonment of up to five years and fines of up to $250,000 per offense. College of The Albemarle (COA) uses faculty, staff and student names and writings, photographs, video and voice recordings for promotional purposes. Materials may appear in print or digital format on the COA website, in various other media formats, and in presentations, videos, social media, advertisements and the news media. Permission is granted to allow COA the unlimited right to use and reproduce individual photographs and videos, interviews, likenesses or the voice of faculty, staff and students in any manner consistent with COA’s mission and for the internal or external promotional and informational activities of COA, unless an individual opts out by submitting this form. Parents of students under the age of 18 may opt out of media release for their student by submitting this form. Students enrolled in Career and College Promise will have the option to opt-out on the COA CCP application.
The request to opt-out must be received by Tammy W. Sawyer, Director of Communications/Marketing within the first ten (10) days of the semester or within the first ten (10) days of enrollment or employment. You, or your student, may return the opt-out form, to Tammy W. Sawyer by scanning and emailing, mailing, or dropping it off at any of the COA front desk locations. If you drop it off, please be sure to address it to Tammy W. Sawyer.
*SPECIAL NOTE: Anyone attending public events held at the college or on behalf of the college, may be photographed, videoed, and/or live-streamed at these events as they are open to the public. Event examples include, but are not limited to, COA digital or live-stream broadcasts such as graduations, concerts, special events, recognitions, award programs, etc.

All schools accepting federal funds are required to participate in awareness and commemoration of the day the U.S. Constitution was signed – Sep. 17, 1787. Faculty and staff may also encourage course assignments or student activities to commemorate Constitution Day.
Institutions are required to obtain approval for local and distance postsecondary educational activities. These activities include, but are not limited to, non classroom experiences, faculty members who reside outside of North Carolina, proctoring, professional licensure and marketing. Compliance with individual state requirements is part of the Higher Education Opportunity Act (HEOA) of 2008. To meet this requirement, COA has joined NC-SARA to serve students in the states outside of North Carolina.
